Execution by Ukraine of judgments of the European Court of Human Rights in the cases of Zhovner v. Ukraine, Yuriy Nikolayevich Ivanov v. Ukraine, and Burmych and Others v. Ukraine

CO-OPERATION WITH THE COUNCIL OF EUROPE

Co-operation of the Council of Europe with Ukraine on the implementation of judgments of the European Court of Human Rights, in particular in the cases of Zhovner, Ivanov, Burmych and others, is quite extensive. As a result of this co-operation, certain positive changes designed to ensure the implementation of the necessary general steps in order to implement the specified judgments of the European Court of Human Rights have already been achieved.

The Council of Europe Action Plan for Ukraine for 2018-2021 was adopted to strengthen co-operation and make a concrete definition of steps aimed at strengthening this co-operation. In particular, it indicates that one of the priority areas is to provide support to Ukraine in the creation of appropriate mechanisms for the implementation of European Court of Human Rights judgments in order to harmonise the provisions of the legislation, institutional response, case law and administrative practice with the requirements of European standards, as well as strengthening the implementation of the provisions of the European Convention on Human Rights and European Court of Human Rights case law at the national level. Thus, within the framework of technical co-operation, the Council of Europe continues to actively support the efforts and initiatives of the Ukrainian authorities to introduce mechanisms and instruments designed to implement the standards and recommendations of the Council of Europe for the implementation of the European Court of Human Rights judgments in cases against Ukraine, especially those concerning structural problems, namely non-execution or delays in the execution of the judgments of national courts.

The necessary expert assistance to ensure the achievement of the set goals is provided by the Department for the Execution of Judgments of the European Court of Human Rights of the Council of Europe, as well as the Projects of the Council of Europe in Ukraine. As part of the implementation of these projects, the Council of Europe supports the preparation of analytical information for the adoption of strategic documents designed to implement the European Court of Human Rights judgments in the cases of Zhovner, Ivanov and Burmych, as well as the development of detailed and comprehensive recommendations for improving legislation, institutional response, case law and administrative practice required to solve the problems stated in the above European Court of Human Rights judgments.
