Execution by Ukraine of judgments of the European Court of Human Rights in the cases of Zhovner v. Ukraine, Yuriy Nikolayevich Ivanov v. Ukraine, and Burmych and Others v. Ukraine

SUPERVISION OVER THE EXECUTION BY THE COMMITTEE OF MINISTERS OF THE COUNCIL OF EUROPE

The Council of Europe, through its statutory governing body – the Committee of Ministers of the Council of Europe – supervises the execution by the member states of the obligations arising from the judgments of the European Court of Human Rights in which it found a violation of the requirements of the European Convention on Human Rights. In particular, the Committee of Ministers of the Council of Europe assesses the status of implementation of individual judgments of the European Court of Human Rights on the basis of reports provided by the respondent states on the steps taken of a general and individual nature and determines whether these steps were sufficient for the full implementation of the European Court of Human Rights judgments. By analogy, the Committee of Ministers of the Council of Europe can evaluate plans for future actions of the state aimed at full and timely implementation of the judgments of the European Court of Human Rights and recommend that the authorities of Ukraine take steps on the basis of the European Convention on Human Rights, European Court of Human Rights case law, its practice, the law of the Council of Europe, etc.
