“The Ministry of Justice of Ukraine is ready to form an effective working group, which should be represented by five departments of the MoJ, whose competence now relates to occupation of the AR Crimea as well as representation of victims affected by occupation of Crimea”, - said Gia Getsadze at the “Financial Club” meeting, which was held on July 20, 2015, where the following topic was discussed: “Whether the Ukrainian business will be able to receive compensation from Russia for the annexation of Crimea.”
The Deputy Minister of Justice also noticed that legal entities and individuals affected by Crimean occupation have several ways to reimburse their losses, particularly, within domestic courts and at international level (ECHR, legal protection under agreements on mutual assistance, protection of foreign investments, filing civil claims in criminal proceedings, US courts and international arbitration). And Oschadbank’s appeal to international courts will create a practical platform for future applications of affected legal entities on the same grounds.
Regarding the assessment of property located on occupied territory and that is currently unavailable for access, Gia Getsadze said that under current legislation the assessment of property can be made in case the applicant has appropriate title documents on such property or other information, including technical documentation, etc.
The meeting was also attended by the Chairman of Oschadbank Management Board Andrey Pyshnyy, managing partners and representatives of the leading law firms Arzinger and Asters, other experts.
