“Our task is not only to introduce the institute of private enforcement officers, but also to bring enforcement of judgments to European level”, - stated the Deputy Minister.
To do so, it is necessary to raise prestige of this profession in order to attract new professional employees.
“Working conditions and salaries don’t attract specialists to the enforcement sector”, - he added.
Serhiy Shkliar pointed out that the process of launching a full-fledged private enforcement officers’ institution won’t be quick. In the near future the main amount of enforcement of judgments will be performed by state specialists. That’s why it is necessary, first of all, to focus on improving their work.
“First of all, it is necessary to improve the enforcement proceeding procedure. Secondly, it is necessary to increase remuneration of state enforcement officers to motivate them in their work. Thirdly – resolve matters related with professional education and to review current teaching courses by adapting them to the present day”, - emphasized the Deputy Minister.
He also pointed out that establishment of a public registry of debtors is among the innovations of the developed Law on enforcement proceeding.
“Such step will positively affect the number of enforced judgments. Because every debtor automatically makes it into the register, after the enforcement proceeding. It is going to be generally accessible and that is why a person will do anything to be excluded from the register”, - stated Serhyi Shkliar.
This register can also be used by businessmen to check how trustworthy is the contractor and whether he is listed as a debtor or not.
Later, with participation of the Ministry of Justice, a legislation will be developed that will allow to speed up the procedure of blocking an account.
“It takes us several days to perform this procedure. In the west – it takes about several minutes. We plan to develop and submit this bill for consideration to the parliament by December this year”, - he stated.
Our next step is to facilitate access to registers and to create a unified register, which is going to be used by representatives of all authorities and institutions.
“Development of these bills will accelerate the enforcement process and it will make it more efficient”, - summarized Serhiy Shkliar.
